Terms And Conditions

CNA Electric Ltd. – Standard Terms and Conditions

Effective Date: October 18, 2025

 

1. Definitions

1.1 – CNA Electric Ltd. is hereafter referred to as the “Electrical Contractor.”
1.2 – The agreement for electrical services between the client (the “Client”) and the Electrical Contractor is hereafter referred to as the “Contract.”
1.3 – Headings are for reference only and do not affect the interpretation of this document.

 

2. Standard Exclusions

2.1 – Unless otherwise stated in the Contract, the Client is responsible for the following:
a) All utility company fees and connection charges.
b) Temporary power, lighting, or internet services.
c) Job site cleanup or waste removal.
d) Replacement of materials damaged or stolen offsite by others.

 

3. General Conditions

3.1 – Quotes and Contracts are valid for 30 days from the date issued unless otherwise stated.
3.2 – The Electrical Contractor is not responsible for errors or deficiencies in designs, drawings, or materials provided by others.
3.3 – All materials and equipment supplied by the Electrical Contractor are warranted only to the extent of the manufacturer’s warranty, unless otherwise specified in writing.
3.4 – Neither party shall be liable for delays or damages due to Force Majeure events such as natural disasters, pandemics, strikes, civil unrest, or any event beyond reasonable control.
3.5 – The Contract excludes work outside of the electrical trade, including mechanical, gas fitting, carpentry, drywall, painting, or patching, unless specifically listed in the Contract.
3.6 – Latent or concealed conditions (e.g., hidden wiring, asbestos, or structural issues) are excluded unless specifically stated in the Contract.

 

4. Work Schedule

4.1 – A mutually agreed-upon Work Schedule may be established between the Electrical Contractor and the Client.
4.2 – If no Work Schedule is set, the Electrical Contractor may determine the schedule at its discretion.
4.3 – Delays or schedule changes caused by the Client or other trades may result in additional charges, with written notice provided.
4.4 – Standard working hours are Monday to Friday, 8:00 AM – 4:30 PM, excluding statutory holidays.
4.5 – Work requested outside of standard hours must be approved in writing and may be billed at overtime rates.

 

5. Change Orders

5.1 – Any work beyond the original Contract scope is considered Additional Work.
5.2 – The Client must provide written or verbal notice for Additional Work. Verbal approval is acceptable for changes under $2,500.00.
5.3 – The Electrical Contractor will provide written or verbal notice before proceeding with Additional Work, using the same dollar threshold.
5.4 – All approved Additional Work will be added to the Contract price and invoiced accordingly.

 

6. Assignment

6.1 – The Client may not assign or transfer the Contract to another party without the written consent of the Electrical Contractor.

 

7. Payment Terms

7.1 – The Electrical Contractor will issue invoices for completed work or progress milestones.
7.2 – Payment is due within 15 days of invoice receipt.
7.3 – Late payments are subject to 2% interest per month (24% annual).
7.4 – The Client is responsible for all collection and legal costs arising from non-payment.
7.5 – All invoices are subject to applicable taxes.

 

8. Travel

8.1 – Travel is billed per kilometre (round trip) from the Electrical Contractor’s office location.
8.2 – For work off Vancouver Island, ferry fees, accommodation, and travel time may also apply.

 

9. Cancellations

9.1 – Cancellations made within 48 hours of a scheduled appointment are non-refundable if a deposit has been paid.
9.2 – Rescheduling requires at least two business days’ notice, subject to availability.

 

10. Materials and Pricing

10.1 – Material costs are subject to adjustment if prices increase by 5% or more between the date of quotation, contract signing, or installation.
10.2 – Increases due to tariffs, freight, or supplier surcharges may be passed on to the Client with written notice.

 

11. Warranty

11.1 – CNA Electric Ltd. provides a one-year warranty on workmanship for all electrical installations completed by the Electrical Contractor or its subcontractors.
11.2 – The warranty period begins on the date of energization or substantial completion, whichever occurs first.
11.3 – Warranty work will only be performed during regular working hours.
11.4 – For projects off Vancouver Island, travel expenses may apply and must be paid prior to service.
11.5 – Warranty work on Vancouver Island may include a $85.00 service call fee, at the discretion of the Electrical Contractor.
11.6 – Emergency service calls are not included under warranty.
11.7 – If applicable, the Electrical Contractor may offer remote system support for monitoring-enabled systems.
11.8 – If remote support is not possible, on-site service will be scheduled at the Electrical Contractor’s discretion.

 

12. Client Responsibilities

12.1 – The Client agrees to maintain a safe and accessible worksite at all times.
12.2 – The Client shall not hold the Electrical Contractor liable for injury, property damage, or financial loss caused by third parties or by conditions outside the Contractor’s control.
12.3 – The Client is responsible for maintaining property insurance and liability coverage related to the project.
12.4 – The Electrical Contractor is not responsible for damages or issues caused by the Client’s failure to maintain installed systems.

 

13. Dispute Resolution

13.1 – In the event of a dispute, both parties agree to first attempt good-faith resolution through written communication.
13.2 – The Electrical Contractor reserves the right to rely on the Builders Lien Act, S.B.C. 1997, c. 45 for non-payment.
13.3 – The Client will indemnify the Electrical Contractor for all legal and collection costs on a solicitor-and-client basis in the event of default.

 

14. Confidentiality and Binding Agreement

14.1 – The Contract is binding upon acceptance, whether signed physically or electronically.
14.2 – This document and any accompanying information are confidential and intended solely for the Client named in the Contract.
14.3 – Unauthorized reproduction, distribution, or disclosure of this document is strictly prohibited.
14.4 – If received in error, please notify CNA Electric Ltd. immediately and return or destroy all copies.
